What is the Digital ID Trustmark?

Entities accredited under the Digital ID Accreditation Scheme can use and display the new Digital ID Accreditation Trustmark, which can be found in Schedule 1 of the Digital ID Rules. However, before using the trustmark an accredited entity must enter into a Trade Mark Licence Agreement.

  • Displaying the trustmark will give users confidence that an accredited entity’s service meets the strict requirements and standards under the Accreditation Scheme. The trustmark can only be used for certain purposes, as specified in the Trade Mark Licence Agreement. 
  • The trustmark must not be used or displayed by any person or organisation that is not accredited under the Digital ID Accreditation Scheme, unless otherwise permitted by the Digital ID legislation.

Using the trustmark

The trustmark is a registered trade mark in Australia.  Accredited entities that wish to use the trustmark must first enter into an agreement with the ACCC. For non-Commonwealth entities, you must agree to the Trade Mark Licence Agreement with the ACCC. This Agreement outlines the terms and conditions for use, ensuring that the trustmark is applied correctly and consistently in accordance with regulatory requirements. The Agreement also includes the Accreditation Trustmark Style Guide, which provides instructions on how to use and display the trustmark. You must email the ACCC at DigitalIDRegulator@accc.gov.au indicating that you agree to its terms before using the trustmark.

For Commonwealth Government entities wishing to use the trustmark, please contact the ACCC at DigitalIDregulator@accc.gov.au to receive the relevant documentation, including the Conditions of Use for Commonwealth Government entities. 

Displaying the trustmark

It is not mandatory for an accredited entity to use or display the trustmark. However, if an accredited entity chooses to do so, it must comply with the relevant terms of use and the requirements set out in the Digital ID Rules, Trade Mark Licence Agreement (or Conditions of Use) and the Accreditation Trustmark Style Guide. This includes that an accredited entity must: 

  • Provide a hyperlink to the Digital ID accredited entities register near the trustmark.  
  • Take reasonable steps to ensure that it is clear to a user which service is an accredited service and which service is not an accredited service. The use or display of the accreditation Trustmark must be specifically in relation to accredited services provided.  
  • Cease use or display of the accreditation trustmark within 7 days if your organisation’s accreditation is suspended or revoked.

There are additional requirements that may apply depending on the type of accredited entity (for example, accredited exchange providers) under the Digital ID Rules. 

Penalties may apply under the Digital ID Rules where an entity does not comply with the Digital ID Rules, including for unauthorised use or display of the trustmark. 

Refer to the Digital ID Rules Chapter 5 - trustmarks for more information on obligations and limitations for accredited entities when using or displaying the accreditation trustmark under the legislative framework. Additionally, there may be other legal consequences for non-compliance with the terms and conditions in the Trade Mark Licencing Agreement.
